AgentKong provides an AI sales agent platform that allows businesses to deploy and build AI sales agents without coding. We offer both monthly and annual subscription plans with varying features and usage limits.

Account Requirements

• You must be at least 18 years old to use AgentKong
• You must provide accurate and complete information when creating your account
• Each account is for one business only - account sharing is not permitted
• You're responsible for keeping your account secure and confidential
• You must notify us immediately of any unauthorized use of your account

Acceptable Use

When using AgentKong, you agree NOT to:

• Use our service for spam, illegal content, or fraudulent activities
• Violate any laws or regulations
• Interfere with or disrupt our service or servers
• Attempt to gain unauthorized access to our systems
• Share your account credentials with others
• Use our service to harm, harass, or impersonate others
• Reverse engineer or attempt to extract our source code

Subscription & Billing

• We offer monthly and annual subscription plans
• Annual plans may include discounts compared to monthly billing
• Usage limits apply based on your selected plan - contact our team or check our pricing page for details
• Billing occurs automatically based on your chosen plan
• If payment fails, your account will be suspended until payment is resolved
• No late payment fees apply - your service simply stops until payment is made

Cancellation & Refunds

• You can cancel your subscription anytime through your billing portal
• Cancellations take effect at the end of your current billing period
• We offer a money-back guarantee for our premium 1-on-1 service where we build your agents and provide marketing audit/implementation
• Standard subscription plans follow our regular cancellation policy
• Refunds for the money-back guarantee require working directly with our team

Data Ownership & Usage

• You retain ownership of the content you input into our platform
• AgentKong owns the AI conversations and data generated through our platform
• We use your data to provide and improve our services
• When you delete your account, all your data is permanently removed
• We may use aggregated, anonymized data for analytics and service improvement

Service Availability

While we strive to provide reliable service, we don't guarantee 100% uptime. Our service may be temporarily unavailable due to maintenance, updates, or technical issues. We're not liable for any losses resulting from service interruptions.

Performance & Accuracy

AI technology is constantly evolving. While our AI agents are designed to be effective, we don't guarantee specific performance results or accuracy. For customers who work with us 1-on-1 for agent building and marketing implementation, we offer our money-back guarantee as outlined in your service agreement.

Price Changes

• We may change our pricing at any time
• Existing customers will receive 30 days notice before price changes take effect
• New prices apply to new customers immediately
• You can cancel your subscription before price increases take effect

Account Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Fail to pay for your subscription
• Abuse our service or support team
• Engage in fraudulent activity
• Use our service for illegal purposes

We'll provide reasonable notice when possible, but reserve the right to terminate accounts immediately for serious violations.

Limitation of Liability

AgentKong is provided "as is" without warranties. We're not liable for any indirect, incidental, or consequential damages arising from your use of our service. Our total liability is limited to the amount you've paid us in the past 12 months.

Intellectual Property

• AgentKong and our technology are protected by intellectual property laws
• You may not copy, modify, or distribute our software or content
• You grant us permission to use your feedback to improve our service

Changes to Terms

We may update these Terms from time to time. We'll notify you of significant changes by email or through our platform. Continued use of AgentKong after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved through binding arbitration or in the courts where AgentKong is located.
